Staywally™

Terms of service

These terms govern your hotel’s use of Staywally. If you have signed a separate order form with us, that document takes precedence where the two disagree.

01Who we are

Staywally is a product of Nammastack. In these terms, “Staywally”, “we”, “us” and “our” mean Nammastack, the company that operates the service and contracts with your hotel.

Nammastack is the merchant of record for Staywally: all fees and refunds are processed in the name of Nammastack, charges and credits appear as “Nammastack” on your card or bank statement, and every invoice for the service is issued by Nammastack.

02The service

Staywally provides a guest portal, staff and admin consoles, and related integrations, as described on our website and in your order form. We may improve or change features, but we will not remove a material capability from your plan during a paid term without notice and a refund option.

03Your account

You are responsible for the accuracy of your property and staff information, for keeping credentials secure, and for the conduct of accounts you create. Tell us promptly if you believe an account has been compromised.

04Acceptable use

Do not use Staywally to send unsolicited marketing to guests, to store payment card numbers outside the payment provider, or to collect data from guests that you have no lawful basis to collect. Do not attempt to access another tenant’s data or to probe the service for vulnerabilities without our written agreement.

05Fees and payment

Fees are built from your property: a platform base fee, a per-room charge for your room count, a per-seat charge for staff beyond the first ten (which are included), and any add-on features you enable, scaled by your property class. They are billed monthly or annually in advance, plus applicable GST. Adding rooms, seats or features part-way through a period is prorated for the days remaining and shown on your next invoice.

All fees are collected by Nammastack, the merchant of record for Staywally. Charges appear as “Nammastack” on your statement and invoices are issued in the name of Nammastack.

Invoices are due within seven days. We may suspend a materially overdue account after written notice, and we will retain your data for 30 days after any suspension.

06Term, suspension and termination

Monthly plans renew automatically and may be cancelled with 30 days’ notice. Annual plans renew for a further year unless cancelled 30 days before the renewal date.

Either party may terminate for material breach that is not cured within 30 days of written notice. On termination you may export your data for 30 days, after which we delete it.

07Service levels and support

Professional plans carry a 99.9% monthly uptime commitment and Enterprise plans 99.95%, each measured against the guest portal and staff console excluding scheduled maintenance announced 48 hours in advance. Service credits are described in your order form.

08Liability

Neither party excludes liability for fraud, wilful misconduct, or anything that cannot lawfully be excluded. Subject to that, our aggregate liability in any twelve-month period is limited to the fees you paid us in that period, and neither party is liable for indirect or consequential loss.

09Governing law

These terms are governed by the laws of India, and the courts at Pondicherry have exclusive jurisdiction.
